Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Mixt mobile application, website, content, community features, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use Mixt

Mixt is designed for adults, including parents and caregivers. You must be legally able to agree to these Terms. Children may not create their own Mixt accounts. If you add information about a child, you represent that you are the child’s parent, legal guardian, or otherwise authorized to provide that information.

2. Accounts and account security

You agree to provide accurate account information, protect your login credentials, and promptly notify us if you believe your account has been accessed without permission. You are responsible for activity performed through your account. You may request account deletion through the Service or by contacting Mixt Support.

3. Educational information—not medical advice

Mixt provides educational hair-care information, field guides, routines, styling ideas, and product suggestions. The Service does not provide medical diagnosis, treatment, or professional medical advice and is not a substitute for a qualified healthcare or hair-care professional. Stop using a product or technique that causes pain, burning, swelling, sores, unexpected hair loss, or another concerning reaction, and seek appropriate professional help.

4. Product and routine suggestions

Recommendations are based on information you provide and general research. Hair and scalp responses vary, and Mixt does not guarantee that a product, ingredient, style, or routine will work for every person. Product formulas, labels, prices, reviews, and availability may change. Check the current package label, follow manufacturer instructions, patch test when appropriate, and consider known allergies or sensitivities before use.

5. Community content

The Service may allow you to post text, replies, experiences, and other material (“User Content”). You retain ownership of your User Content. You grant Mixt a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content only as reasonably needed to operate, secure, moderate, and improve the Service. This license ends when the content is deleted, except for copies reasonably retained for legal, security, backup, or moderation purposes.

You are responsible for your User Content and must have the right to share it. Community experiences are individual opinions and are not verified endorsements or professional advice from Mixt.

6. Acceptable use

You may not use the Service to:

  • harass, threaten, shame, exploit, or discriminate against another person;
  • post hate speech, sexual exploitation material, scams, spam, or unlawful content;
  • share another person’s private information without permission;
  • give dangerous instructions or present medical claims as established fact;
  • impersonate another person or misrepresent your affiliation;
  • interfere with the Service, probe its security, introduce malicious code, or access it through unauthorized automated means; or
  • violate applicable law or another person’s intellectual-property or privacy rights.

The Community Guidelines are part of these Terms.

7. Moderation and enforcement

Mixt may review reports and may hide, remove, restore, or restrict access to User Content or accounts when we reasonably believe it is necessary to enforce these Terms, protect users, comply with law, or maintain the Service. We cannot guarantee that all objectionable content will be identified immediately. You may report community content using the tools provided in the app.

8. Subscriptions and purchases

Mixt may offer optional paid subscriptions. The purchase screen will show the current price, billing period, included benefits, and any trial or introductory terms before you subscribe. Unless expressly described as non-renewing, subscriptions automatically renew for the same billing period until canceled. Your Apple App Store or Google Play account is charged according to the terms shown at purchase.

You can manage or cancel a subscription through the store account used to purchase it. Cancellation normally takes effect at the end of the current paid period. Refunds and billing disputes are handled under the applicable app store’s rules and applicable law. Mixt may change subscription pricing or benefits with the notice and consent required by the applicable store and law.

9. Third-party services and links

The Service may rely on or link to third-party services, retailers, product manufacturers, app stores, and websites. Their products, content, availability, privacy practices, and terms are controlled by those third parties. A product suggestion or link does not guarantee availability or create a warranty or endorsement.

10. Mixt content and intellectual property

Except for User Content and third-party material, the Service and its software, design, text, graphics, branding, research organization, and other content are owned by or licensed to Mixt and are protected by applicable intellectual-property laws. Mixt gives you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No other rights are granted.

11. Service changes and availability

We may update, add, suspend, or discontinue features as the Service evolves. We will provide notice when required by law. We do not promise that the Service will always be available, uninterrupted, or error-free.

12. Suspension and termination

You may stop using Mixt at any time. Mixt may suspend or terminate access for a material or repeated violation of these Terms, a security threat, unlawful conduct, or when necessary to protect other users or the Service. Provisions that by their nature should survive termination—including ownership, disclaimers, and limitations of liability—will survive.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Mixt disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Mixt does not warrant particular hair, scalp, styling, or product results. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Mixt will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or business opportunity, arising from the Service. Mixt’s total liability for claims relating to the Service will not exceed the greater of the amount you paid to Mixt during the twelve months before the claim or US $100. These limitations do not apply where prohibited by law.

15. Changes to these Terms

We may update these Terms as the Service changes. We will post the updated Terms and revise the effective date. If a change materially affects your rights, we will provide additional notice when required. Continuing to use the Service after updated Terms take effect means you accept them.

16. General terms

These Terms and the Privacy Policy form the agreement between you and Mixt regarding the Service. If a provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without Mixt’s consent. These Terms are governed by applicable law, without limiting any mandatory consumer protections that apply where you live.
